Terms of Service

1.What OrganicDeck does

OrganicDeck follows the public social media accounts you add to a project, on TikTok, Instagram, YouTube, Facebook, X and Snapchat. It measures their posts over time, reads slideshows and videos with artificial intelligence (“Intelligence”) and answers questions about them.

What each plan includes, such as videos tracked, how often we measure, members, and questions and readings per month, is shown on our pricing page and in Settings → Plan.

OrganicDeck is made for businesses. You must be at least 18 years old and use it for your work or your company.

2.Your account and projects

• You sign in with a one-time code we send to your email. Whoever can read that email can get into your account, so keep it secure.
• Your work lives in projects. A project's owners add and remove members and manage its plan and billing. A project always keeps at least one owner.
• Each person needs their own account. Don't share your sign-in with anyone.
• You're responsible for what happens in your projects, including what the members you add do there.
• Keep your email up to date so we can reach you about your account and billing.

3.Public data from social platforms

OrganicDeck only measures what anyone can see publicly: profiles, posts and their counts, like views, likes, comments, shares and followers. We never ask for the passwords of your social accounts and we don't sign in to them.

We collect this data with our own systems and with third-party data collection services. Platforms change what they show and how they show it, so some counts may be missing, rounded or late, and a platform may limit or block access at any time. We work to keep measurements complete and on schedule, but we can't guarantee that every post or every count will be available.

You can add accounts you don't own, such as your creators' accounts or other brands'. Use what you learn about them lawfully. Don't use OrganicDeck to harass, stalk or profile anyone, or to make decisions about a person's employment, credit, housing or insurance.

OrganicDeck isn't affiliated with, endorsed or sponsored by TikTok, Instagram, YouTube, Facebook, X or Snapchat. Their names and logos belong to their owners and appear only to identify each platform.

Posts, images and videos belong to their creators. OrganicDeck shows them so you can analyze how they perform. Don't republish content from other creators that you found through OrganicDeck unless you have the right to.

4.Intelligence and AI

Intelligence uses AI models to read slideshows and videos, label hooks and structures, explain why a post took off and answer your questions. The figures in its answers come from our measurements, not from the model. The descriptions, explanations and suggestions are generated and may be wrong or incomplete, so check anything important before relying on it.

Readings and questions count against your plan's monthly amounts. A reading is one slideshow or one started minute of video, up to three per video. We read up to the first three minutes of each video.

We may reuse the AI reading of a public post for every customer who tracks that post. Your questions, conversations, attached images and project description are used only for your project.

We don't use your content to train AI models. The AI company we work with processes it only to return an answer and, under its terms for paid services, doesn't use it to train or improve its models.

5.Your content

Your content is what you put into OrganicDeck: the accounts and links you add, groups, notes, saved ideas, questions, attached images, and your project's website and description. It stays yours.

You give us a worldwide, non-exclusive license to host, copy, process and display your content only to run, secure and improve the Service for you, and as our Privacy Policy describes.

You confirm you have the rights to put your content into OrganicDeck and that it doesn't break the law or anyone's rights.

We never show your content to other customers, and they can't see which accounts your project tracks.

You may use the numbers, readings and answers you get from OrganicDeck, including exports, for your business.

6.Acceptable use

You agree not to:

• Break the law, or use OrganicDeck to infringe anyone's intellectual property, privacy or other rights.
• Rotate accounts to measure more than your plan includes, meaning add accounts or posts, remove them and add others again and again so a project measures far more videos over a month than its plan allows. We limit how many new videos a project can add each month to prevent this, and we may limit or suspend a project that does it.
• Get around your plan's limits in other ways, for example by opening repeated trials for the same team or company.
• Access the Service with bots, scrapers or scripts, except through features we offer for that purpose, or place an unreasonable load on it.
• Resell, sublicense or share access to OrganicDeck, or use it or its data to build a competing product or dataset.
• Reverse engineer the Service, test its security, or bypass any protection or limit.
• Upload malware, or content that is illegal, sexualizes minors, or is meant to harass or threaten.
• Use OrganicDeck to infer or profile people's sensitive traits, such as health, religion, sexual orientation or political views.
• Use the Service from a country under a U.S. embargo, or if you're on a U.S. sanctions list.

If we believe you've broken these rules, we may remove content, limit features, or suspend or close the project or account involved.

7.Plans, trial and payment

Each project has its own plan, billed monthly or yearly in advance. Prices are in U.S. dollars and don't include taxes, which are calculated and added at checkout. Checkout may show the price in your local currency.

Stripe processes payments, and Link (link.com), a Stripe service, acts as merchant of record: it charges you, collects the applicable taxes and sends your receipts and invoices. Your card statement will show a charge from LINK.COM* ORGANICDECK. Link's terms also apply to the payment.

Free trial. A new project can start with a 7-day free trial of the plan it chooses, which requires a payment method. The trial includes the whole plan except Intelligence, which is limited to 1,000 readings and 20 questions. If you don't cancel before the trial ends, the plan starts and the first period is charged automatically. There's one trial per project and per person, and we may decline or end trials opened to get around that.

Renewal. Your plan renews automatically at the end of each period, at the price in effect then, until you cancel. You authorize us, through Stripe and Link, to charge your payment method at each renewal.

Changing plans. An upgrade takes effect right away and you pay the prorated difference. A downgrade takes effect at the end of the current period. If your project then uses more than the new plan allows, what it already tracks keeps being measured, but you can't add more until it fits.

Extras. Packs of extra videos are added to a paid plan and billed with it every period. Adding packs charges the prorated amount right away, and removing them credits the unused part to your next invoice. Top-ups of Intelligence readings or questions are one-time purchases, used once the plan's monthly amount runs out. They don't expire, but they can only be used while the project has a plan, and they can't be moved to another project.

Failed payments. If a payment fails, Stripe retries it. If it can't be collected, the plan is cancelled.

Price changes. We may change our prices. We'll tell you at least 30 days before a change applies to you, and it will apply from your next renewal. If you don't agree, cancel before then.

Cancelling. Project owners can cancel anytime in Settings → Plan, and you can also cancel from your Link account. The plan stays active until the end of the period you paid for and doesn't renew. Our Refund Policy explains when we give money back.

8.When a plan ends

When a plan ends, the project stops being measured and you can't add accounts. You can still sign in and see everything that was measured.

We may delete a project that has gone 12 months without a plan. We'll email its owners at least 30 days before.

You can export your posts as a CSV file while you have access. To have a project or your account deleted sooner, write to [email protected].

9.Availability and changes to the Service

We work to keep OrganicDeck available and to measure on your plan's schedule, but we don't promise it will be uninterrupted or free of errors. Maintenance, platform changes and outages outside our control can delay measurements.

We keep improving OrganicDeck and may add, change or remove features. If we remove something that's a material part of your plan, or stop measuring a platform, we'll tell you in advance and you can cancel.

10.Suspension and termination

You can stop using OrganicDeck and cancel your plan at any time.

We may suspend or close your account or a project if you break these terms, don't pay, put OrganicDeck, other customers or third parties at risk, or if the law requires it. We'll give you notice first when it's reasonable to do so. If we close your account for none of these reasons, we'll refund the unused part of your prepaid period.

Everything that by its nature should last after these terms end will last, including payment obligations, licenses to content, disclaimers, limits on liability, indemnity and how disputes are resolved.

11.Our property and your feedback

OrganicDeck, its software, design and brand belong to us or our licensors. We give you a limited, non-exclusive and non-transferable right to use the Service under these terms while your account is active. All other rights are ours.

If you send us ideas or feedback, we can use them without owing you anything.

We may use aggregated data about how OrganicDeck is used to run and improve it. That data never identifies you, your project or your members.

12.Disclaimers

OrganicDeck is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.

We don't guarantee any result from using OrganicDeck, such as views, followers or sales. Measurements depend on what platforms make public, and AI output can be wrong.

13.Limitation of liability

To the fullest extent the law allows:

• Neither you nor we will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if warned they were possible.
• Our total liability for all claims related to OrganicDeck or these terms is limited to what you paid us for the Service in the 12 months before the event that caused the claim, or US$100 if that is more.

These limits don't apply where the law doesn't allow them.

14.Indemnity

You'll defend and indemnify Titun LLC and its members, employees and agents against claims by third parties, and the resulting costs, including reasonable legal fees, arising from your content, your use of OrganicDeck against these terms, or your violation of any law or third-party right.

15.Governing law and disputes

These terms are governed by the laws of the State of New Mexico and applicable U.S. federal law, without regard to conflict-of-law rules.

If there's a dispute, write to us first at [email protected], and we'll try to resolve it informally within 30 days. If we can't, it will be decided exclusively by the state or federal courts located in New Mexico, and both of us accept their jurisdiction.

Nothing in these terms removes rights that the mandatory law of your country gives you.

16.Changes to these terms

We may update these terms. If a change is material, we'll let you know by email or in the app at least 15 days before it takes effect. If you keep using OrganicDeck after that, you accept the new version. If you don't agree, cancel your plan before the change takes effect. The date at the top of this page shows the current version.

17.General

• These terms, our Privacy Policy and our Refund Policy are the entire agreement between you and us about OrganicDeck.
• If any part of these terms can't be enforced, the rest remains in effect.
• If we don't enforce a right, we haven't waived it.
• You can't transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of our business.
• Neither of us is responsible for delays caused by events beyond reasonable control, such as outages of platforms, networks or hosting, natural disasters or government action.
• We send notices to your account's email or show them in the app. You can send us notices at [email protected].
• If a translation of these terms differs from the English version, the English version governs.
